Paid Time Off/Vacation Policy (Multi-State)

A Standard Document that provides a model policy for private employers establishing paid time off for their employees. This Standard Document offers customizable language that allows employers to create a policy that functions as a general Paid Time Off (PTO) policy, a vacation-only policy, or a combined vacation and sick leave policy. It can be used as a stand-alone document or integrated into a broader employee handbook. This policy addresses critical components such as employee eligibility, the rate and manner of leave accrual, rules for carrying over unused time, and procedures for requesting leave. Furthermore, this Standard Document discusses important legal considerations that impact paid leave policies, including potential payout obligations upon termination of employment, compliance with the National Labor Relations Act (NLRA), and the significant tax implications under Section 409A of the Internal Revenue Code concerning deferred compensation.
