Real Estate Development Agreement (Affiliated)
A long form development agreement for a commercial real estate development project between a property owner and a developer affiliated with an investor in the owner. In this form of development agreement, the developer is responsible for overseeing the predevelopment, construction, and post-completion phases of an office, retail, multifamily, mixed-use, or other commercial development project. While development agreements are generally governed by state law, this jurisdictionally-neutral template is useful and relevant in every state. This Standard Document has integrated notes with important explanations and drafting and negotiating tips for both property owners and developers.
