Remote Employees: Best Practices
This Practice Note describes legal considerations and best practices for employers with remote employees. It addresses the main risks and responsibilities for employers to consider when employing a remote workforce, including remote work as an accommodation under the Americans with Disabilities Act (ADA), timekeeping and compensable time under the Fair Labor Standards Act (FLSA), health and safety issues, information security, use of electronic signatures, and more. It also discusses ways to handle challenges with onboarding and other aspects of managing the employment relationship, including fulfilling employers' obligations under the Immigration Reform and Control Act (IRCA), training, workplace postings, and performance management. This Note addresses federal law but provides some examples of state law considerations.
